The New South Wales Supreme Court of Appeal (NSWCA) has allowed the appeal of a former sergeant of police (appellant) who suffered an infirmity while on duty. The NSWCA held that the appellant was a person aggrieved by the decision to commence his additional hurt on duty pension from the date on which his application form was received, rather than from the date the appellant was medically discharged from the NSW Police Force. The fact that the application form was not completed did not indicate that he did not seek the backdating of any additional pension.
